Home Rental Agreement – What You Need to Know!

A home rental agreement is an important document for both the landlord and the tenant as it contains all the rules both parties have to follow. In other words, a home rental agreement is a type of legal contract which specifies important and specific details such as the amount of rent the tenant has to pay every month and the length of the tenancy to name a few. As the home rental agreement is the foundation of the relationship between the landlord and the tenant, it is important that both parties are aware of all the terms that exist in it.

Entry rights
The home rental agreement should contain entry rights for the landlord, to avoid complications with the tenant. Failure to include entry rights may result in privacy violation and illegal entry claims, which will be problematic for the landlord, despite it being his/her property. Entry rights will contain all the conditions which allow the landlord to enter the rental property.

For example, if the landlord needs to make repairs to the rental property, the home rental agreement will specify how many hours/days in advance he/she needs to notify the tenant.

Fees and deposits
A large number of problems arise when the landlord has to return the security deposit to the tenant. There are specific descriptions of fees and deposits to keep situations such as legal problems and confusion at bay.

The description will state how much deposit the tenant needs to give to the landlord. It will also give more information such as non-refundable fees for painting, cleaning, and repairs. Such details give a clearer picture to the tenant on how the landlord is going to use the security deposit.

Illegal and disruptive activities
The rental agreement will include what the landlord considers as illegal and disruptive activities, to avoid problems with their neighbors and other residents. It is also a countermeasure to prevent the tenant from damaging the property of the landlord.

Some of the common illegal and disruptive activities that most rental agreements have includes peddling drugs and excessive noise. If the tenant is found guilty of illegal and disruptive activities, the landlord has the right to terminate the home rental agreement.

List of all tenants
If more than a single adult is living in the rental property, then the agreement will contain all their names. The reason why the rental agreement lists out all the names of the tenants is to hold them responsible for all the terms that are included by the landlord. In other words, the landlord has the right to ask one of the tenants to pay for damages or the rent, if others are unable to do it.

Occupancy limit
There will be an occupancy limit defined in the rental agreement so that the landlord can keep a check on how many tenants can reside on the property legally. Landlords include occupancy limit to prevent the tenants from letting their relatives and friends stay with them. It also puts a check on sub-letting the rental property without the knowledge of the landlord.

The rental agreement will have provisions for how much rent the tenant has to pay to the landlord on a monthly basis. It will also include additional details such as the acceptable modes of payment, when the amount is due, and late fees for the delay in settlement of rent.

Repair and maintenance
Repair and maintenance is another area of the rental agreement which is extremely important as it gives a clear description of the duties of the tenant. For example, the rental agreement can state that it is the tenant’s duty that the property is clean and free of damage at all times. It can also inform the tenants that they will be held responsible for all the damages that occur due to negligence.
